1. General information
These Terms of Sale apply to all purchases of rooftop tents for vehicles (hereafter referred to as “Products”) made by customers (“Customer”) through Montaña, based in Victoria, Australia, via the website available at montañaactive.com (“Website”).
These Terms apply exclusively to purchases made directly through the Website. The version of the Terms of Sale in effect at the time the order is placed will govern that specific order. By checking the “I accept” box during the order confirmation process, the Customer acknowledges they have read, understood, and fully accepted these Terms. If the Customer does not agree to the Terms, no purchase may be completed.
Acceptance of these Terms, together with the product descriptions provided on the Website for each item, fulfills the seller’s legal obligation to provide clear and accurate information before contract finalization, ensuring transparency and protecting the consumer. By using the Website, the Customer also agrees to Montaña’s Privacy Policy, which is considered an integral part of these Terms.
2. Eligibility to purchase
Products are available for purchase worldwide.
To place an order, the Customer must:
• Be of legal age (18 or older in Italy);
• Have the legal capacity to enter into binding contracts.
If the Customer is a minor or otherwise legally unable to contract, a parent or legal guardian must place the order on their behalf and accept these Terms. Any order placed in breach of this requirement will be considered void. Orders may only be placed by registered users.
3. Product availability
All orders placed through the Website are subject to product availability and Montaña’s approval. Montaña reserves the right to modify the selection of available products at any time. Product pages and Customer Service provide updated availability details. If any of the selected products are unavailable, Montaña will notify the Customer. If payment has already been made, the Customer will be fully refunded, and the order will be cancelled.
4. Personal information
To place an order, Customers must register and provide accurate, up-to-date personal information, including full name, billing/shipping address, and email. This information is required for order fulfillment. Montaña is not responsible for issues arising from incorrect or false information provided by the Customer.
5. Prices, taxes, duties, and shipping cost
All prices shown on the Website’s product pages include applicable taxes, duties, and shipping costs.
6. Order review and confirmation
Before finalizing an order, the Customer must carefully review all details, including product specifications and pricing. To complete the order, the Customer must check the box confirming unconditional acceptance of these Terms, then click “Proceed to Checkout.”
7. Payment
Payment methods available are listed on the Website. All credit/debit card holders are subject to authorization and validation checks by the card issuer or chosen payment provider. If authorization is declined, it is the Customer’s responsibility to resolve the issue directly with the card issuer.
For credit card payments, financial details (e.g., card number, expiration date) are encrypted and securely transmitted to the authorized payment processor. Montaña does not access or store this information. Orders will be processed only after payment has been successfully received.
8. Security
Montaña is committed to protecting Customers' personal data throughout the online purchase process. However, due to the nature of the internet, Montaña cannot guarantee complete data security and cannot be held liable for damages resulting from cyberattacks or system intrusions.
9. Order confirmation
Montaña will send a confirmation email to the Customer upon receipt of the order.
10. Shipping - Transport - Packaging
Shipping fees are included in the product price. No additional payment is required.
PACKAGING
Returns must be shipped in the original packaging (box and internal protection). If unavailable, the Customer must provide suitable packaging at their own expense and accepts full responsibility for any damage during transit.
TRANSPORT AND PACKAGING
Each product is shipped in a sturdy wooden crate with internal padding.
1. Upon delivery, Customers must check that the packaging is intact. Any signs of tampering or missing items must be noted on the delivery document and signed by the courier. Issues must be reported by the next business day.
2. This procedure is required to qualify for insurance coverage for any damage. Late or incomplete reports will not be accepted.
11. Invoicing
Once the order has been fulfilled, Montaña will issue an invoice and send it to the billing email address provided by the Customer.
12. Warranty
Products and accessories are covered by a 1-year warranty from the date of purchase/delivery.
13. After-sales support
Montaña provides after-sales assistance. For repair or service inquiries, contact Customer Service at: hello@montañaactive.com. Montaña will respond within 7 business days.
14. Intellectual property rights
The Montaña brand, along with all associated intellectual property—including product and packaging designs, images, logos, texts, and graphics—remain the exclusive property of Montaña. Reproduction, use, copying, resale, or transfer to third parties is strictly prohibited.
15. Legge applicabile e soluzioni delle controversie
These Terms of Sale and the purchase agreement are governed by Australian law.
